These Terms of Service ("Terms") govern your access to and use of Toravine (the "Service"), operated by Smart Technology Investments LLC. By using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Toravine, you represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them.
2. Description of Service
Toravine uses CMS plan data, AHRQ MEPS health expenditure distributions, FDA NDC drug databases, and actuarial modeling to compare Medicare plans. The Service provides estimated annual cost projections, formulary matching, provider network verification, Star Rating analysis, and Monte Carlo cost simulations.
3. Not Medical or Insurance Advice
Toravine is not a licensed insurance broker, agent, or medical professional. We do not receive commissions from any insurance company. The plan comparisons and cost estimates provided are based on publicly available CMS data and statistical models. They do not constitute recommendations to enroll in or decline any specific plan.

4. Data Accuracy
Cost estimates are derived from CMS Plan Finder data and AHRQ MEPS distributions that are updated on their own schedules. We do not guarantee accuracy, completeness, or timeliness. Cost estimates are probabilistic, not guarantees.
5. Credits and Billing
Single reports cost $12, report packs provide 5 reports for $35, and API credit packs are available for developers. All fees are in U.S. dollars and are non-refundable except as required by law.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART TECHNOLOGY INVESTMENTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
8. Governing Law
These Terms are governed by the laws of the State of California. Any dispute shall be resolved by binding arbitration in Los Angeles County under the AAA rules.
